Ballarat Gold Mine Operators Charged After Fatal Rockfall Investigation

A detailed 20-month investigation into a deadly rockfall at a Victorian gold mine has resulted in formal charges against the owner and operator. The incident, which occurred deep underground, claimed one life and severely injured another, prompting a thorough review of workplace safety practices.

Tragedy Strikes Ballarat Gold Mine

On March 13, 2024, a devastating collapse unfolded at the Ballarat Gold Mine in Mount Clear, located in Victoria, Australia. Thirty miners were working kilometres below the surface when the rockfall occurred. While 28 workers successfully made it to safety, 37-year-old Bruthen resident Kurt Hourigan tragically died. Additionally, 21-year-old Connor Smith suffered critical, life-threatening injuries.

At the time of the collapse, the miners were reportedly engaged in "air legging," a manual and potentially dangerous mining technique that involves using a handheld drill. This method is now a focal point of the ongoing scrutiny into the mine's safety protocols.

Charges Laid by WorkSafe Victoria

WorkSafe Victoria, the state's primary workplace safety regulator, announced today that it has laid charges against two entities: Victory Minerals, the current owner of the mine, and Carr Mining Services, its operator. The charges allege significant failures, including neglecting to ensure a safe workplace, inadequate supervision of workers, and the crucial omission of installing sufficient ground supports within the mine infrastructure.

These serious matters are scheduled for a hearing at the Ballarat Magistrates' Court in December, where both companies will address the allegations.

Internal Concerns and Management Decisions

The investigation has also brought to light troubling internal communications from April 2024. Emails reportedly show a staff member raising explicit concerns with management, advising against proceeding with a handheld drilling trial without implementing "minimum" ground supports. Alarmingly, it was also revealed that the company expressed concerns that the necessary ground supports were contributing negatively to the "cost of production." The geotechnical engineer who voiced these safety warnings was subsequently terminated within weeks of these internal communications, raising further questions about the company's priorities.

A Community Mourns: Remembering Kurt Hourigan

Kurt Hourigan was lovingly remembered by his family and friends as "one of nature's true gentlemen" and a "gentle giant." Tributes highlighted his selfless and kind nature, and it was noted that his mining hat bore the names of his children on its underside – a poignant detail underscoring his dedication to his family. A fundraiser established for his daughter described him as "one of a kind, an absolute larrikin, an adventurer, a quirky free spirit, a true gentleman."

Controversially, the Ballarat Gold Mine resumed operations just one day after Mr. Hourigan's body was recovered, a decision that has been met with considerable public and community reaction.

Previous Warnings and Ownership Changes

The WorkSafe charges are not the first regulatory action against Victory Minerals this year. Resources Victoria previously issued two infringement notices to the company. Victory Minerals took ownership of the Ballarat Gold Mine in 2023, following the voluntary administration of the previous owner and operator, Balmaine Gold.

The Australian Workers Union and Victory Minerals have been contacted for their comments regarding these latest legal proceedings and allegations.
