A federal judge has authorized the release of critical evidence in the case involving Marimar Martinez, a Chicago woman who was shot by a Border Patrol agent. The materials include text messages from Agent Charles Exum, body camera footage, photos, and FBI reports. Judge Georgia Alexakis ruled that these records reveal the agent’s mindset and how DHS responded to the incident.
Martinez was shot five times after her vehicle collided with federal agents’ cars in Chicago. She claims the agents were the aggressors and denies ramming their vehicles. Exum’s body camera was off, but footage from other agents and Martinez’s 911 call provide insight into the chaos. Federal charges against Martinez were dropped, yet officials and social media continued to label her as a threat.
The judge also approved releasing vehicle tracking images and surveillance photos, which may help the public and officials understand DHS’ use of deadly force. Martinez’s attorney stated this evidence will expose the ‘counter-factual PR campaign’ against her and reveal the truth of what happened.
